Q – Do we need to ask our clients to sign the Statement of Rights? 

A – No. Signing the Statement of Rights is not a requirement under the new Aged Care Act. 

Under Section 155, you must: 

  • Give the older person information about their rights 

  • Provide them with a copy of the Statement of Rights 

  • Help them understand the information and their rights. 

You must do this before or at the time you start delivering funded aged care services. 

You're also required to keep records that show you’ve met your obligations – including sharing the Statement of Rights (previously called the Charter of Rights). 

There’s no need to collect a signed copy. It’s up to each provider to decide how they show they’ve done the right thing.
